Consent to the processing of personal data on the terms and in the way specified in the Privacy Policy

I (hereinafter - “Subject”), acting freely, consciously, in accordance with my will and in my own interest, understanding the subject of this consent unambiguously, give my consent to the processing of personal data indicated by me when filling out the application form for training (hereinafter - “Consent”) to the individual entrepreneur Kapustin Sergei Viktorovich (hereinafter - “Operator”).

My personal data may be processed under the conditions and in the way specified in the applicable law and in the Privacy Policy below.

Privacy Policy

This privacy policy applies to products available online by individual entrepreneur Sergei Viktorovich Kapustin, when using which users provide personal data.

  1. 1. General terms

    1. 1.1 The Operator makes the most important goal and condition of its activity the observance of human and citizen's rights and freedoms during the processing of personal data, including the protection of the rights to privacy, personal and family secrecy.

    2. 1.2 This consent given in relation to the processing of personal data applies to all information that the Operator may receive within the scope of the operation of the Website from the Personal Data Subject.

    3. 1.3 Submission of the Consent shall mean checking the corresponding checkbox next to this Consent and clicking the “Submit” button in the form for filling in personal data on the Website when the Subject submits their personal data to the Operator.

    4. 1.4 Personal data subjects should refrain from filling out the form, checking the appropriate checkbox and clicking the “Send” button, or similar in meaning, on the Website, in case of disagreement (in full or in part) with the User Agreement, Personal Data Processing Policy, which means disagreement to provide personal data to the Operator or give consent to the Operator to transfer personal data to third parties.

    1. 2.1 Automated processing of personal data - processing of personal data with the help of computers.

    2. 2.2 Blocking of personal data - temporary cessation of personal data processing (except for cases when processing is necessary to update personal data).

    3. 2.3 Website - a set of information, texts, graphic elements, design, images, photo and video materials and other results of intellectual activity, as well as computer programs contained in the information system that ensures the availability of such information on the Internet at the network address (including subdomains): https://apexnovatech.com

    4. 2.4 Personal data information system - a set of personal data contained in databases and information technologies and technical devices ensuring their processing.

    5. 2.5 Personal data depersonalization - actions, as a result of which it is impossible to determine, without using additional information, the belonging of personal data to a particular Personal Data Subject.

    6. 2.6 Processing of personal data - any action (operation) or set of actions (operations) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (update, change), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.

    7. 2.7 Personal Data - any information relating directly or indirectly to a specific or identifiable Subject using the Site.

    8. 2.8 Personal Data Subject - a person who provides their personal data to the Operator via the website.

    9. 2.9 Personal data provision - actions aimed at disclosure of personal data to a certain person or a certain number of people.

    10. 2.10 Distribution of personal data - any actions aimed at disclosure of personal data to an indefinite number of people (transfer of personal data) or familiarization of personal data to an unlimited number of people, including disclosure of personal data in mass media, placement in information and telecommunication networks or providing access to personal data in any other way.

    11. 2.11 Cross-border transfer of personal data - transfer of personal data to the territory of a foreign country to a foreign government authority, a foreign individual or a foreign legal entity.

    12. 2.12 Destruction of personal data - any actions, as a result of which personal data are irreversibly destroyed with the impossibility of further recovery of the content of personal data in the information system of personal data and (or) material storage media of personal data are destroyed.

    13. 2.13 Law on Personal Data - Federal Law dated 27.07.2006. No. 152-FZ “On Personal Data”.

    14. 2.14 IP address - a unique network address of a node in a computer network built using the IP protocol.

    15. 2.15 In case of uncertainty of the concepts used in this agreement, they shall be understood in the meaning defined in the Personal Data Processing Policy, and in the absence of such definition - in the commonly used meaning.

  3. 3. Basic Rights and Obligations of the Operator

    1. 3.1 The operator has the right to:

      1. 3.1.1 receive from the subject of personal data reliable information and/or documents containing personal data;

      2. 3.1.2 in case the personal data subject revokes their consent to personal data processing, the Operator has the right to continue personal data processing without the consent of the personal data subject if there are reasons specified in the Personal Data Law;

      3. 3.1.3 independently determine the definition and list of measures necessary and sufficient to ensure the fulfillment of obligations stipulated by the Law on personal data and regulatory legal acts taken in accordance with it, unless otherwise provided by the Law on personal data or other federal laws.

    2. 3.2 The operator is obligated to:

      1. 3.2.1 provide the personal data subject, upon their request, with information regarding the processing of their personal data;

      2. 3.2.2 organize the processing of personal data in accordance with the procedure established by the current legislation of the Russian Federation;

      3. 3.2.3 respond to appeals and requests of personal data subjects and their legal representatives in accordance with the requirements of the Law on personal data;

      4. 3.2.4 report to the authority responsible for the protection of the rights of personal data subjects, upon request of this authority, the necessary information within 30 calendar days from the date of receipt of such request;

      5. 3.2.5 to take legal, organizational and technical measures to protect personal data from illegal or accidental access to them, destruction, modification, blocking, copying, provision, dissemination of personal data, as well as from other illegal actions in relation to personal data;

      6. 3.2.6 stop transfer (dissemination, provision, access) of personal data, stop processing and destroy personal data in the way and in the cases stipulated by the Personal Data Law;

      7. 3.2.7 fulfill other duties specified by the legislation.

  4. 4. Basic rights and obligations of personal data subjects

    1. 4.1 The subject of personal data has the right to:

      1. 4.1.1 receive information regarding the processing of their personal data, except in cases provided for by federal laws. Information shall be provided to the subject of personal data by the Operator in an accessible form and shall not contain personal data relating to other subjects of personal data, except in cases where there are legal grounds for disclosure of such personal data. The list of information and the procedure for obtaining it is established by the Law on Personal Data;

      2. 4.1.2 demand from the operator to update his personal data, block or destroy them in case the personal data are incomplete, outdated, inaccurate, illegally obtained or are not necessary for the stated purpose of processing, as well as to take measures provided for by law to protect his rights;

      3. 4.1.3 withdraw consent to the processing of personal data;

      4. 4.1.4 fulfill other rights specified by the legislation of the Russian Federation.

    2. 4.2 The subject of personal data is obliged to:

      1. 4.2.1 provide the Operator with true data about himself;

      2. 4.2.2 notify the Operator about clarification (update, change) of their personal data.

  5. 5. Personal data processed by the Operator

    1. 5.1 The Operator may process the following personal data (including biometric data) of the Personal Data Subject:

      • - Full name;

      • - E-mail addresses;

      • - Passport data and registration address of the Subject;

      • - Phone numbers;

      • - IP address;

      • - other information necessary for the provision of services.

    2. 5.2 The aforementioned data are hereinafter referred to as Personal Data in the text of the Consent.

    3. 5.3 The Operator does not process special categories of personal data regarding race, nationality, political opinions, religious or philosophical beliefs, intimate life.

    4. 5.4 Processing of personal data authorized for distribution from among the special categories of personal data specified in Article 10.1 of the Personal Data Law is allowed if the prohibitions and conditions provided for in Article 10.1 of the Personal Data Law are complied with.

  6. 6. Principles of personal data processing

    1. 6.1 Processing of personal data must be carried out by the Operator on a lawful and fair basis.

    2. 6.2 The processing of personal data is limited to the fulfillment of specific, predetermined and legitimate purposes. Processing of personal data incompatible with the purposes of personal data collection is not allowed.

    3. 6.3 It is not allowed to merge databases containing personal data processed for purposes incompatible with each other.

    4. 6.4 Only personal data that meet the purposes for which they are processed shall be processed.

    5. 6.5 The content and scope of processed personal data correspond to the stated purposes of processing. It is not allowed that the processed personal data are redundant in relation to the stated purposes of their processing.

    6. 6.6 When processing personal data, the accuracy of personal data, their sufficiency and, where necessary, relevance to the purposes of personal data processing are ensured. The Operator shall take the necessary measures and/or ensure that they are taken to delete or update incomplete or inaccurate data.

    7. 6.7 Personal data shall be stored in a form that allows identification of the subject of personal data for no longer than required by the purposes of personal data processing, unless the period of personal data storage is established by the federal law or a contract to which the subject of personal data is a party, beneficiary or guarantor. Processed personal data shall be destroyed or depersonalized when the purposes of processing are achieved or when it is no longer necessary to achieve these purposes, unless otherwise provided for by federal law.

  7. 7. Transfer of personal data to third parties

    1. 7.1 Personal data of the Data Subject shall be disclosed to third parties only in cases related to the compliance of the applicable law.

    2. 7.2 Any personal information is subject to secure storage and non- distribution. Transfer of the Subject's personal data to third parties may be carried out with the consent of the Subject of personal data only for the purposes specified in clause 8 of this Consent.

    3. 7.3 The Subject's consent to the transfer of thier personal data to third parties may be withdrawn by the Personal Data Subject or their representative by sending a written application to the Operator at the Operator's registration address specified in the preamble of this Consent, or by sending a written Application in the form of a scan or a photo of the Application to the Operator's e-mail address apexnovatechnologies@gmail.com. The Consent may be withdrawn upon notification at least ten (10) business days prior to the proposed date of termination of data processing by the Operator.

  8. 8. Purposes of processing and transfer of personal data

    1. 8.1 Purposes of processing and transfer of the Personal Data Subject's personal data to third parties.

      1. 8.1.1 Identification of the Personal Data Subject (without the use of biometric personal data) for the purposes of execution of contracts concluded between the Subject and the Operator, including for the purposes of ensuring the required level of security, including access control and compliance control, including issuance of passes for execution of contracts concluded between the Subject and the Operator.

      2. 8.1.2 Identification of the Personal Data Subject.

      3. 8.1.3 Keeping records of persons who have paid for the Operator's services when providing access to information materials and courses;

      4. 8.1.4 Use of the Site and its individual pages on the Internet;

      5. 8.1.5 Registration of the Personal Data Subject in the Operator's database;

      6. 8.1.6 Filling in individual forms with personal data by the Personal Data Subject.

  9. 9. Legal basis for personal data processing

    1. 9.1 The legal basis for the processing of personal data by the Operator is:

      1. 9.1.1 Contracts concluded between the operator and the subject of personal data;

      2. 9.1.2 Federal laws, other regulatory legal acts in the field of personal data protection;

      3. 9.1.3 Consent of the Personal Data Subject to the processing of their personal data.

    2. 9.2 The Operator processes the Personal Data Subject's personal data only if it is filled in and/or sent by the Personal Data Subject independently via special forms located on the Website or sent to the Operator's postal or e-mail address.

    3. 9.3 The subject of personal data independently decides on the submission of their personal data and gives consent freely, of their own free will and in their own interest.

  10. 10. Terms of personal data processing

    1. 10.1 Processing of personal data is carried out with the consent of the subject of personal data to the processing of their personal data, unless otherwise provided for by the law of the Russian Federation.

    2. 10.2 Processing of personal data may be necessary for the fulfillment of the operator's or third parties' rights and legitimate interests or for the achievement of socially important purposes, provided that the rights and freedoms of the personal data subject are not violated.

    3. 10.3 The Operator may process personal data to which an unlimited number of people have access by the personal data subject or at their request (hereinafter referred to as publicly available personal data).

    4. 10.4 The Operator may process personal data that is subject to publication or mandatory disclosure in accordance with federal law.

  11. 11. Procedure for collection, storage, transfer and other types of personal data processing

    1. 11.1 The security of personal data processed by the Operator is ensured by implementing legal, organizational and technical measures necessary for full compliance with the requirements of the current legislation in the field of personal data protection. The Operator shall ensure safety of personal data and take all possible measures to exclude access to personal data by unauthorized people.

    2. 11.2 In case of any inaccuracies in personal data, the Personal Data Subject may update them independently by filling out the “Profile” form on the learning platform.

    3. 11.3 The period of personal data processing is determined by the achievement of the purposes for which the personal data were collected, unless another period is stipulated by the contract or applicable law. The personal data subject may withdraw their consent to the processing of personal data at any time by sending a notice to the Operator by e-mail to the Operator's e-mail address apexnovatechnologies@gmail.com marked “Withdrawal of consent to the processing of personal data”.

    4. 11.4 All information that is collected by third-party services, including payment systems, communication tools and other service providers, is stored and processed by these parties (Operators) in accordance with their User Agreement and Privacy Policy. The Operator is not responsible for the actions of third parties.

    5. 11.5 The Operator shall store personal data in a form that allows to identify the subject of personal data for no longer than required by the purposes of personal data processing, unless the period of storage of personal data is established by federal law or an agreement between the Operator and the Subject.

    6. 11.6 The condition for termination of personal data processing may be the achievement of the purposes of personal data processing, expiration of the personal data subject's consent or withdrawal of consent by the personal data subject, as well as detection of illegal processing of personal data.

  12. 12. List of actions performed by the Operator with received personal data and trans-border transfer of personal data

    1. 12.1 The Operator shall collect, record, systematize, accumulate, store, clarify (update, change), extract, use, transfer (disseminate, provide, access), depersonalize, block, delete and destroy personal data.

    2. 12.2 The Operator performs automated processing of personal data with or without receiving and/or transmitting the received information via information and telecommunication networks.

    3. 12.3 Takes measures necessary and sufficient to ensure compliance with the requirements of the legislation of the Russian Federation in the field of personal data.

    4. 12.4 Trans-border transfer of personal data is not performed by the Operator.

  13. 13. Cross-border transfer of personal data

    1. 13.1 Trans-border transfer of personal data is not performed by the Operator.

  14. 14. Privacy of personal data

    1. 14.1 The operator and other parties who have access to personal data are obliged not to disclose to third parties and not to distribute personal data without the consent of the subject of personal data, unless otherwise provided for by federal law.

    2. 14.2 The Operator is not responsible for unauthorized transfer of the subject's personal data by third parties.

  15. 15. Final terms

    1. 15.1 The subject of personal data may obtain any explanations on issues of interest regarding the processing of their personal data, information on the subject's personal data processed by the Operator, by contacting the Operator by sending a written application to the Operator at the Operator's registration address specified in the preamble of this Consent, or by sending a written Application in the form of a scan or a photo of the Application to the Operator's e-mail address apexnovatechnologies@gmail.com.
