User Agreement

  1. 1. General conditions

    1. 1.1 This User Agreement (hereinafter - the Agreement) regulates the relations between the Individual Entrepreneur Sergei Viktorovich Kapustin (hereinafter - the Operator) and the user of the website https://apexnovatech.com (hereinafter - the User).

    2. 1.2 This Agreement is a public offer. The User is obliged to carefully read its terms and conditions. Registration on the site and use of its functionality means full and unconditional acceptance of the terms of this Agreement.

  2. 2. Definitions

    1. 2.1 Website - a set of graphic and informational materials, as well as computer programs and databases, ensuring their availability on the Internet at the network address https://apexnovatech.com.

    2. 2.2 Operator - Individual Entrepreneur Sergei Viktorovich Kapustin, who manages the website.

  3. 3. Subject of the Agreement

All developments made by the Operator are the intellectual property of the Operator and are protected by copyright and other applicable laws. The User agrees not to use these developments in violation of the Operator's rights.

  4. 4. Rights and obligations of the parties

    1. 4.1 The operator has the right to:

      1. 4.1.1 Modify the website, add and remove any informational materials and services.

      2. 4.1.2 Restrict access to the website if the User violates the terms and conditions of the Agreement.

      3. 4.1.3 Collect and process Users' personal data in accordance with the Privacy Policy.

    2. 4.2 The Operator agrees to:

      1. 4.2.1 Ensure that training materials are available as scheduled and as specified on the website.

      2. 4.2.2 Provide technical support to Users in case of problems with access to training materials and other materials of the site.

    3. 4.3 The user has the right to:

      1. 4.3.1 Use all services available on the website.

      2. 4.3.2 Contact the Operator for explanations on issues related to the fulfillment of this Agreement.

      3. 4.3.3 Demand from the Operator to protect their personal data in accordance with the Privacy Policy.

    4. 4.4 User agrees to:

      1. 4.4.1 Use the website for legitimate purposes only.

      2. 4.4.2 Not to take actions aimed at disrupting the normal functioning of the website.

      3. 4.4.3 Respect copyrights and do not distribute materials.

  5. 5. Liability of the parties

    1. 5.1 The Operator is not responsible for technical failures of the website caused by force majeure, actions of third parties or technical problems on the side of the communication provider.

    2. 5.2 The Operator shall not be liable for the User's losses resulting from the use or inability to use the website, including, but not limited to, loss of data, lost profits or any other indirect losses, unless such losses are caused by the intentional actions of the Operator.

    3. 5.3 The User is solely responsible for violating the laws of the Russian Federation when using the website, including, but not limited to, copyright infringement and any other illegal actions.

    4. 5.4 The user is responsible for respecting the copyrights and other rights of third parties when using the training materials provided on the website.

    5. 5.5 The user is responsible for providing accurate information when registering and using the website.

  6. 6. Dispute resolution procedure

    1. 6.1 All disputes and disagreements arising out of this Agreement shall be settled through negotiations.

    2. 6.2 In case of failure to reach an agreement, the dispute shall be considered in court in accordance with the laws of the Russian Federation.

    3. 6.3 Before going to court, the parties undertake to take all possible measures to settle the dispute through negotiations and correspondence.

  7. 7. Final provisions

    1. 7.1 This Agreement comes into effect from the moment of its acceptance by the User and is valid indefinitely.

    2. 7.2 The Operator shall have the right to amend this Agreement. The new version of the Agreement shall come into effect from the moment of its posting on the website, unless otherwise specified by the new version of the Agreement.

    3. 7.3 The User is responsible for independently following the changes to the Agreement posted on the website.

    4. 7.4 This Agreement and all relations related to the use of the website shall be governed by the laws of the Russian Federation.
